Senate GOP continues to fight for small business relief

DENVER – The Colorado Senate Republicans continue to lead the charge on delivering relief for Colorado’s small businesses.

Today, Senate BIll 24-134 passed unanimously in the Senate. The bill encourages the development, and protects the operation of small businesses by prohibiting HOAs from restricting the operation of home-based businesses.

“This legislature must do everything it can to alleviate costly burdens levied on our small businesses, Senator Smallwood said. “Colorado’s businesses are being regulated to a point of bankruptcy– by freeing home-based business owners of unnecessary regulations, including those from some HOAs, we are fostering an environment in which our state’s small businesses can thrive.”


According to a 2020 survey of U.S. business conducted by the Small Business Trends, almost 70% of all businesses in the United States are launched from the owners’ home. Under current law, HOAs are free to impose costly regulations on these businesses, and even prohibit their operation entirely. 

The bill would not allow for businesses to operate completely unchecked, however. HOAs may still enforce ordinances regarding noise, parking, and landscaping.

Senate Bill 24-134 passed unanimously out of the Senate Local Housing and Government Committee last week. The bill is due to be considered in the Colorado House of Representatives in the coming weeks.
